Are OSH services mandatory for all companies?
Yes, in Portugal, according to Law no. 102/2009 of September 10 and its updates, Occupational Health and Safety (OSH) services are mandatory for all companies with dependent workers, regardless of size or sector of activity. All companies are responsible for organizing OSH services or contracting them out in order to guarantee the health and safety of their workers, implementing appropriate prevention and protection measures.

Are companies with employees working 100% remotely required to organize OSH services?
In Portugal, as per the current legal framework for teleworking employees, Law 83/2021 of December 6, companies bear the responsibility for the safety and health of their workers, whether they are on-site or working remotely. Therefore, even if the employee is working 100% remotely, the company is still required to organize Occupational Health and Safety (OHS) services. -
Are complementary diagnostic tests part of the mandatory health surveillance protocol?
In Portugal, the mandatory health surveillance protocol for workers is outlined in Law No. 102/2009 of September 10 and its updates. While the law defines the rules for health surveillance, it does not specify mandatory additional diagnostic tests. The legislation states that health surveillance should align with the assessment of occupational risks, and the specific surveillance measures are determined by the occupational health physician based on this risk assessment.
